Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of the Weblinear ERP platform, including all related websites, mobile applications, and services (collectively, the “Services”) provided by Weblinear Technologies LLP (“Weblinear,” “we,” “our,” or “us”).
By creating an account, accessing, or using any part of the Services, you (“Subscriber,” “you,” or “your”) agree to be bound by these Terms. If you are entering into these Terms on behalf of an organization, you represent and warrant that you have authority to bind that organization.
Description of Services
Weblinear ERP is a cloud-based enterprise resource planning platform that provides tools for accounting, invoicing, human resource management, customer relationship management, project management, and related business operations. The specific features available to you depend on the subscription plan you select.
User Accounts
To access certain features of the Services, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that we reasonably believe violate these Terms or are used for unauthorized purposes.
Subscription & Billing
- Plans: Access to the Services is provided on a subscription basis. Features, usage limits, and pricing are determined by the plan selected at the time of purchase.
- Billing Cycle: Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan. All fees are non-refundable unless otherwise stated.
- Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel at least 24 hours before the renewal date.
- Late Payment: We reserve the right to suspend access to the Services if payment is not received within 7 days of the due date.
- Taxes: All fees are exclusive of applicable taxes, which will be charged as required by law.
Acceptable Use
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party rights
- Reverse-engineer, decompile, or attempt to extract the source code of the platform
- Store or transmit malicious code, malware, or fraudulent records
- Exceed the resource limits defined in your subscription plan
- Share login credentials across multiple individuals or organizations
- Engage in automated scraping or stress-testing without prior written consent
Intellectual Property
Our Property: The Services, including all software, code, design, trademarks, and documentation, are the exclusive property of Weblinear Technologies LLP and are protected by applicable intellectual property laws.
Your Property: All data, records, and content that you upload or create through the Services remain your exclusive property. Weblinear does not claim any ownership rights over your business data.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEBLINEAR TECHNOLOGIES LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.
Our total aggregate liability for any claim arising out of or relating to these Terms shall not exceed the total amount paid by you to Weblinear in the six (6) months immediately preceding the event giving rise to the claim.
Termination
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. We may terminate or suspend your access immediately, without prior notice, if you breach these Terms.
Upon termination:
- Your right to access the Services will cease immediately
- You will have a 90-day grace period to export your data
- All outstanding fees become immediately due and payable
- Provisions that by their nature should survive termination will remain in effect
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in West Bengal, India.
